If you’re a freelancer and work as an independent contractor for other businesses OR you are the business hiring an independent contractor, then you need to have a Work Relationship Clause in your contract (aka "Independent Contractor Clause"). This clause ensures all parties agree to the work relationship being an independent contractor and not employee-employer, explains that the contractor is responsible for all taxes, insurance, etc., and that a 1099-NEC will need to be issued by the company if paid over $600 in the calendar year OR that a 1099-K form will be sent by a payment settlement entity if the requirements are met (this clause will help you prevent receiving both forms).
