Fees & Retainer Clause
If you are a service provider and have a contract but need to add in a Fees and Retainer Clause, this is for you! This clause is a hefty one and has two options for whether you take a smaller retainer/reservation fee and then take installment payments over the course of your services, OR if you take a retainer/reservation fee and then one final payment within 'x' days of the date of service. Both options include the ability to have a FLAT FEE retainer or a percentage-based retainer.
This clause also includes language regarding the non-refundability of the retainer, late payments, and no downgrades on the package agreed to but upgrades are available, keeping the retainer as liquidated damages in the event of breach, updates to your pricing, and additional hours charged beyond the scope of the Agreement. This clause can be used by graphic designers, planners, online coaches, photographers, videographers, florists, DJs, and any other service industry professional.
**Note, this is an all-inclusive fee clause with multiple paragraphs. You do not need to purchase any additional late fee clauses or changes to pricing clauses in addition to this one (with the exception of florists or caterers who may want to add in a right to adjust pricing clause to their contract due to fluctuations in wholesale prices of goods).
